Jury rules against hospital in birth injury case

Delivery-related care is one of the types of care that hospitals typically provide. It is very important for all hospitals here in Connecticut to not commit negligence when providing such care. When a hospital and its staff act negligently in relation to a delivery, it can lead to birth injuries occurring.

A verdict was recently reached in a birth injury case. The case was from another state.

The case centered on a delivery that occurred at a hospital in Michigan in January 2008. The mother of the child who was delivered accused the hospital of negligence. Specifically, she alleged that the delivery was not performed in the way that it should have been and that this resulted in her child, a girl, suffering nerve damage during the delivery. According to the child's mother, this nerve damage caused the child to lose some use of her right arm and to suffer disfigurement.

The child's mother sued the hospital in relation to these allegations. A trial was held in regards to this lawsuit. The trial lasted 12 days. The jury ultimately ruled in favor of the child's mother and granted her a large monetary award.

As this case shows, parents will sometimes pursue medical malpractice claims when they believe that medical negligence caused their child to suffer a birth injury. Birth injury cases can involve many different things. One thing that often plays a major role in birth injury cases is expert witness testimony.
