Settlement reached in wrongful death case

It is very important for medical professionals and medical facilities to not act negligently when providing care to a patient in relation to a procedure. Such negligence can be a very serious matter. Such negligence can sometimes even result in a patient dying.

Recently, a wrongful death case that involved allegations of the above-mentioned type of negligence has been settled. The case was from Virginia. The case involved a young boy who underwent a dental procedure at a pediatric dental clinic of a state university in Virginia.

The boy's family alleged that negligence occurred in connection to care the boy received in relation to the procedure. Included among the negligence the boy's family claimed occurred were: a failure to properly monitor the boy before, during the process of and after anesthetizing him for the procedure and a failure to timely detect a condition the boy reportedly developed during the procedure (the condition in question was an inadequate and/or obstructed airway).

According to the boy's family, this alleged negligence resulted in the boy dying. The boy died in May 2010.

The boy's family brought a wrongful death lawsuit in relation to the above allegations. The boy's family and the state of Virginia have reached a settlement in regards to this lawsuit and a judge recently approved the settlement. Reportedly, as part of the settlement, the boy's family will receive a monetary payment. The settlement does not include any admissions of wrongdoing or liability by the state.

No patient should have to suffer harm or lose his or her life because a medical professional or medical facility failed to act properly when proving him or her with care. Thus, one hopes that medical professionals and medical facilities are held accountable when they engage in harmful negligence towards patients.
